EFFORTS TO PROTECT CHILDREN FROM PREDATORS IN PRISON VISITING ROOMS
Child Predators are a threat to children in prison visiting rooms, especially in light of the fact that they receive no rehabilitative treatment. A court filing by La Merle seeks to prevent their access to children in these visiting settings. A child has been molested in a California visiting room. Amador County Judge recently issued an order ordering State Attorney General to informally respond to the legal filing. Click here for the Court Order issued by the Court May 24, 2007. EFFORTS TO PROTECT CHILDREN FROM PREDATORS IN PRISON VISITING ROOMS
The California Supreme Court denied the writ November 1, 2006, S142658, stating that I had failed to allow the prison the opportunity to address the issues.
The Court was legally correct in its reasoning. My reasoning behind going directly to the Supreme Court was because I believed and believe that an avoidable crisis loom when continuously placing children in an environment where it is easy to predict that harm can come. And so instead of going through the prison-appeal process which can take 6-12 months, I went directly to the Court.
What the Court did not know was that even after filing the writ, I did file a prison-appeal. In May 2006, prison officials told me that I had no standing to complain of children being placed in danger in the visiting rooms because I could not show an immediate adverse effect to myself; prison refused to process the appeal which could effectively bar Court-Review/Intervention.
After the Courts denial of the writ I filed another prison-appeal. When filing the appeal, I attached the Supreme Courts decision directing me to allow the prison to respond. This time the prison addressed the issues. Denying the 602, stating that the Decision was a Director/Legislative/Court issue and that it (Mule Creek State Prison) lacked jurisdiction to do such a thing; (Thing: protect children from known predators). The appeal is currently pending in Sacramento at the Secretary of Corrections level; if denied I will be filing a writ in the Amador County Superior Court. I'll keep you informed.
Video-News-Cast
In the very near future we will begin to offer video feed news-casts. We have completed a piece on HIV and the adverse effect it is having on the communities, and we are currently working on a piece that will address the child-predator issue in visiting rooms.
The pieces will appear on youtube.com and realisticreform.com (if the pieces not immediately available on realistic, it will at least offer a link to the youtube.com posting). If you agree with the issues, fell free to direct others to the postings (video) and ask them to request political/media intervention.
If you have any ideas about future news stories, feel free to e-mail and share them with us.
HIV/Writ (Legal Filing)
Still pending in the California Supreme Court. Undoubtedly it will meet with a similar fate as the child predator one. The 602 (Prison Appeal) on this issue has been exhausted and will immediately be filed in Amador County Superior Court when able. Prison Appeal denied throughout every level. Prison refused to process the appeal, but it was sent to Sacramento for processing. Note: If prison refuses to process an appeal the Court(s) will sometimes allow the prisoner to proceed because the prison had the opportunity to address the issue but refused.

Future Inmate Contributors
In the near future we hope to have Trans-Gender and/or other homosexual inmates contribute their views on various topics. In particular I am of the opinion that society (mainly women) needs to know what the ladies imprisoned in male prisons have to tell them.
We will also have contributions from individuals who have horrific crimes, (crimes involving children, etc.), but who need to share their stories and ideas so that all of society can grow from the unchangeable circumstances that got them imprisoned.
Closing
My objective in this site is to jar/shock us into realistically dealing with the issues that if not dealt with will eventually crush us as a society. In giving anyone a voice I am not advocating what the person has done, I'm acknowledging that yesterday is irretrievable and if stopping crimes are our goals, then we had better be willing to hear what those committing them have to say. I have also heard some complaints from other inmates who take offense of my position on some of the issues mentioned; stating that I am trying to exploit society's distaste for child molesters, etc.
I am not, and I welcome their input. To offended inmates and/or other prison-advocacy groups. Our objectives I believe are similar, we just have different ideas on how to get there. Welcome to the choice in being American. My objective is to call it like it is, period. I believe that only through honesty can this change, not sugar-coating anything. Many who agree with me about barring predators from coming into contact with children in prison visiting rooms, take offense at my raw-proposals on rehabilitation of sex-offenders. To them too, I offer no apologies. The reality is that there is not enough places to house those who can be red tagged with sexually deviant thoughts, in the end we just want them not to act on them. And if we do not create a platform/environment where the potential and/or actual offender feels comfortable about what is going on in their minds, then we will continue to have visited upon us the horrible crimes we now know.
Until next time.
La Merle
